James Olivos claims he’s too fat for prison, even though he seems to get around just fine without assistance.

Olivos pled guilty last December to running a real estate scam and the judge ordered he be sentenced to five years in prison and pay back the almost three million dollars he ripped off from other people.

Except Olivos has missed three dates now for the start of his prison term. His excuse: he’s a morbidly obese man and his obesity can’t be sufficiently treated in prison. WESH 2 reporter Bob Keating confronted Olivos about this excuse, and when asked if he still believes he’s too fat for prison, he said, “Yes, I am sir. Thank you very much.”

Magistrate Karla Spaulding got teed off last week when he threw out the medical excuses and accused him of stalling.
