A militia member who came under Border Patrol gunfire after he was mistaken for an immigrant on Friday is a felon.  John Frederick Forester, is part of a militia group camped out on private land near the river.

According to officials, Forester was armed when a Border Patrol agent opened fire on him. He was not injured in the incident.

[su_center_ad]Records show Forester has two misdemeanor convictions for theft and trespassing and felony convictions for burglary of a building and he has served prison time, according to KRGV.

It is illegal for a felon to use a firearm after a conviction and before the fifth anniversary of his or her release from prison, according to state law. Under Federal law, felons are not allowed possess firearms.

That makes Forester in violation of federal statutes.

Officials said the FBI is handling the investigation.

The militia group’s commander told KRGV they only do background checks to see if applicants are on probation or parole.

This is unreal: According to the commander of the armed group, they are considering suing the federal government and the Cameron County Sheriff’s Department over the shots-fired incident.

Law enforcement officials have emphatically stated that these groups are a hindrance to their jobs. These men are untrained, and do not know the area.  On Thursday, a group of armed militiamen wearing camouflage confronted a group of conservationists who were counting bats. The conservationists are very upset over the incident.

“I’m still going to be out there. I’m still going to be vigilant. I might be a little louder towards the agents so that they know that I’m there,” the group’s leader said. “I might even put a red strobe light on my forehead so that they can see. I’m not leaving.”

I’m pretty sure this is not what a ‘well regulated militia’ is.

    For me, personally, the greatest tragedy is my absolute absence of shock while reading this. Five years ago I would have been. I hope one day soon I’ll be capable of shock again.

    so, they check to see if someone is on probation or parole. probation may or may not mean he was charged with a felon, parole definitely he was charged with a felon, and shouldn’t have guns period. idiot savant.

    I don’t believe that they ded a background check.

    These militia groups are not the police or even a security officer. They should be treated as a domestic terrorist group. They should not be allowed to form and be active in this country. They need to break these groups up before it is too late.

    So why did Border Patrol fire on Mr. Forester in the first place? Or do we just give them a pass because you don’t like what Forester and his fellow “militiamen” are doing, even though it’s legal? And maybe even necessary given the lawlessness along the border and the very real possibility of corrupt agents working with the traffickers?

      felons are not allowed to have guns. It is not legal to threaten others on private property that is not theirs.

        15 days!? Catching up with all those posts you don’t like… it’s hard work, I understand. As I remember trigger-happy Border Patrol said they took Forester for an “illegal!” So, of course, they opened fire… All this took place, btw, on public land and I don’t recall anyone being threatened by the militiaman who apparently was not arrested or his gun taken away. He was back out in the field the next day.
