A Las Vegas school teacher is suing Cliven Bundy after her car crashed into one of his cows on Interstate 15 about 10 miles from his ranch, where I suppose he feels his cattle have grazing rights, too. The cow was killed and the car went barreling down an embankment.

According to the Las Vegas Review Journal, The lawsuit filed Sunday in Clark County District Court alleges Bundy “recklessly, carelessly and negligently allowed his cows to enter onto Interstate 15 through an area where he had no grazing or other rights.”

[su_center_ad]Danielle Beck is seeking at least $20,000 for medical expenses, lost income and other damages.

“She’s lucky she lived,” Bob Apple, Beck’s Las Vegas lawyer said. “I’ve been practicing since 1975, and I’ve never seen someone with so many broken ribs.”

It was about 1:15 a.m. on April 14th, less than 48 hours after the Bureau of Land Management abandoned the standoff with Bundy, his armed supporters, including militia members.

According to the Nevada Highway Patrol’s accident report, Beck and her boyfriend encountered cows in both lanes of the road while traveling 70 mph on a dark stretch of Interstate 15.

Her boyfriend tried to stop the car but it hit one of the cows, according to the Associate Press.

Both Beck, 34, and Matthew Zanatta, 40, were taken by ambulance to the hospital in Mesquite.

According to the accident report, authorities arrived on the scene and  had to herd four other cows away from the highway through a hole in the fence along the interstate.

“The cow’s owner never arrived on scene after being contacted by NHP dispatch,” the incident report said.

Bundy has denied any responsibility in the incident and  said it is the state’s job to maintain the fence that keeps his livestock off the interstate.

“It’s a state problem. It’s not our problem,” Bundy said. “We really feel bad when it happens. We sure don’t want it to happen. But we’re not liable.”

But the cows which were grazing there belong to him and Bundy has not had a permit for 20 years.

That land has been closed to grazing.

On Wednesday, the entitled rancher  said, “The person whose car hit that cow is liable to me.”[su_csky_ad]

    Bundy is not going to get out of this one. The state is not responsible for trespassing cows. Public support will be with the victim. If Bundy thought he was getting bad publicity before he is really going to hate what is coming.

      As if he’s going to even respond to this. The Fed hasn’t forced him to comply, despite many victories in court. Do you really think that he will listen here, given his statement, “the entitled rancher said, “The person whose car hit that cow is liable to me.”?

        Having a real victim compared to the government makes a big difference. The government can’t sit and do nothing and wait it out with a real victim involved. A person has more rights. I bet the government gets behind her too. The government may be able bring a lot more pressure on Bundy now.

          Agreed. He is responsible for where his cattle roam. If he were leasing land from an individual – it would still be his responsibity.

            I know the laws in Texas are pretty clear and it is a big no-no to have your cattle on the highways. I would assume the laws are pretty generic and similar.

          More pressure than court orders? I really hope you’ll send me what you’re smoking there! This guy doesn’t recognize the fed, nor the courts. He’s had twenty or so years of proving the Fed is inept and impotent where he’s concerned. He’s winning, he’ll ignore any judgement and have his unemployed militia buddies show up again to protect him against yet another court order.

    Question….why was the owner even contacted, they had a chance to confiscate abandoned property and sold at auction in lieu of non payment of grazing fees.

      They are supposed to show up and deal with the dead livestock and make sure no more are out and fix the fence. This is clear negligence and won’t look good in court. Expect extra amount in punitive damages.

        If he had been paying the fees I can understand that would be the normal course of events but he has refused to do so for 20 years. The feds were chased away at gun point earlier and this would have been an opportunity to settle w/o confrontation.

    Pay-up Welfare Rancher! Irresponsible Bundy always blames everyone else for his liabilities. Bundy hasn’t had a grazing permit for 20 years! That land has been closed to grazing during the entire 21st century. The sheriff & BLM should ticket Bundy for his negligent failure to appear on the scene to corral his cattle.

        That is a completely inaccurate statement. Responsibility for the fence would depend on whether the fence was installed within the highway easement. Regardless, Bundy is responsible for his cattle and where they are at all times. Just like every other farmer/rancher in the country.

          For a roadway to be designated an Interstate Highway there are construction requirements: in this case access control. In other words fences are required on Interstate Highways. Now your comment is accurate in terms of US Highways where controlled access is not a requirement.

        trespassing Kows are already in violation of the law. Interstate Highways are US properties. The officials responsible for arresting the Kriminal Kows were locked and loaded on by Kliven’s Kow Krews., preventing them from doing their duties as paid servants of the American people. Kliven is a criminal and by the LAW as set forth in the Patriot Act, a terrorist and terrorist enabler. Why send US half way around the world, when they’re right here in Nevada?

          Controlled access, which includes fences, to Interstate Highways is a design, construction, and maintenance requirement.

            Even if this is true, Bundy would still have to have an agreement with the State, wouldn’t he, for such an obligation to exist on the part of the State?

            If there IS no grazing on the land (the State’s contractual understanding), then there IS no obligation for the State to control access to that land, is there?

            The controlled access is to the Interstate right of way not to BLM land. My original point is that the fence between BLM land and I-15 is part of I-15 and thus owned by the state.

      I don’t like defending this old racist, but to clarify he expects the federal government to not claim rights to land within the state of Nevada when the people of Nevada want to use the land they live in. He expects the state of Nevada to maintain interstate highways, which includes maintaining the fence (which may or may not be true, I tried but couldn’t find a citation, best I could do is this link: https://www.leg.state.nv.us/NRS/NRS-705.html#NRS705Sec120 )

        hold on. i’m confused, it happens. but, i own my property, and i have to pay property tax, a portion of my taxes go to the fed. govt. why should he be exempt? and his fence is his property, period.

    Just why can’t they throw his ass in prison? I mean, he DID face down federal police with a militia of his own. And he’s grazing on land that he doesn’t own. Both are arrestable offenses. Not to mention the fact that he owes the US government untold amounts of money. Wouldn’t that be akin to tax dodging?
