    Totally ridiculous! The cops that did turn their backs were acting like CHILDREN. Since they chose to act like CHILDREN they need to be punished accordingly because they refused a direct order. $500 fine?…3 days suspension without pay?…written up for insubordination? Fired? If they don’t respect immediate authority I question whether they can respect ALL citizens of NYC…

            It’s not should have been, It WAS illegal for him to own a firearm. federal law makes possession of a gun by a felon punishable by 10 years in federal prison. Use of the gun in a crime adds to the sentence. .

            Why are you under the impression that it was the shooter who actually purchased the gun from the Pawn Shop? As stated in other answers, the Pawn shop would have to have filed a form 4473 and the shooter would have had to undergo a NICS check, and with his criminal history, he would have failed.

            So I am a little lost at how you can say block the bills that would have prevented it, when this is already law of the land under the Brady Bill.

            I’m betting he didn’t get the gun at the corner “Grab-a-Gun” and most likely bought it via black market.
            Which, according to probability, means the gun probably originated as a straw purchase at a gun show where they don’t have to provide any personal information or go through any background checks.

            So, either way, it’s conservative talking points that support keeping these lethal loopholes open and Republican actions that make sure they aren’t addressed properly.

            You are completely wrong. A straw purchase is where someone with a clean background buys the gun for the felon. There is a background check. Your fantasy world where criminals buy guns at gun shows because there are no background checks doesnt exist

            Actually, it does.
            A straw purchase, more strictly speaking, is a purchase one make for another… regardless of who’s a felon.
            Sure, your version is the most common, but it’s not the only way it’s accomplished.

            If you purchase a gun at a gun show, you don’t need to go through a background check.. so even if you are a felon, you can still purchase a gun for someone else.
            Because they don’t check any ID… all that matters is if you have cash to buy the gun(s).

            If you think there are no illegal purchases being made at gun shows, you’re being willfully ignorant.

            The saddest point about your post, is that you know better. IT WAS ILLEGAL for him to purchase and own a firearm. The pawn shop that sold it has a FFL, hence whoever they sold it to, had to fill out form 4473, and they committed a felony also.

            So we are obviously dealing with a straw purchase. WHICH IS ALSO ILLEGAL !!!

            We seem to be missing a step, because as I’m reading ATF’s form 4473, I find little if any onus on the seller to background check the buyer.

            Instead, the buyer is threatened multiple times with a shaking of fingers to fill out his portion of the form correctly, or else.

            What am I missing?

            here is what you are missing. Any firearm purchased through a FFL, is subject to a NICS check through the FBI database. This person would have been stopped at point of purchase due to his criminal record.

            That is how Straw purchases are developed, where somebody will take a person who can pass a NICS check, and then hand over the firearm there after. Which by the way, is also illegal.

            Regarding Private Sales, I am not familiar with Georgia.s laws. But fairly confident you are not required to run a NICS.

            Thanks. But the seller portions of the form are so littered with optional, if available, if provided and references to NCIS check exemptions, that it makes it appear that little if any check on due diligence of seller is enforced.

            Why, it almost looks as if the sale of the firearm is being facilitated, even encouraged, by arbitrary language and obfuscation. 🙂

            Not sure what you are referring to honestly. Just want to make sure we are looking at the same document. Here is a link to form 4473 from the ATF website. If you have a specific question regarding a specific section, refernce it from this form, this way we are both talking about the same thing.

            Yep, same one I got. The “ifs” and “optionals” I mention are liberally sprinkled throughout section B questions 21, 22, and 23, and I draw your attention to the instructions for these questions, and especially the voluminous list of NICS exemptions listed there (page six).

            Here, let me explain what questions 21a-e are for,and why you are seeing the word “If”.

            The law states, that NICS has to give an answer within 3 days if there is a delay for some reason, if not the FFL, does have the right to transfer the firearm. None ever will, but they have the right to do so. If you look at 21b regarding the NICS transaction number. Well, if it was delayed, and a transfer took place. Then there would be no number to write in.

            On 21c, it refers to if the NICS check comes back as delayed, they have a certain period of time, to finalize. Hence the date. Not all states allow it, so the “If” in that questions refer’s to eligibility.

            same thing with 21d, “IF” initial response was Delayed, it is a section to be filled in with the result and the date. Only applicable if there was a delay.

            Same with 21e, “If Applicable”, meaning that if the FFL had in fact made the transfer after 3 days, and the response came in afterwords. What was the response.

            22, what that means, is that a person who is purchasing a firearm that is classified by the national firearms act which is basically machine guns and fully automatic weapons. that person has to have a tax stamp issued by the federal government. In order to have that stamp, you are sent through the wringer for being background checked, more then you can imagine. So the Stamp itself, is your background check.

            23, If you hold a valid CCW, you already have been through the system, thus they are giving the exemption.

            Fot the most parts, your concerns about seeing if and Optional, really have no bearing. They are there for specific reasons. It is not that the seller is not conforming to the law, or not wanting to. Hope this helps explain why it is there.

            I’m not at all heartened by the fact that the FFL can transfer the firearm if there is a delay of more than three days in the NICS scheck, and not at all convinced that as you say “but no FFL ever will.”

            It just seems that there are so many ways for this mechanism to fail.

            I am happy to discuss this with you. It is the only way we learn. I will
            give you an example of something that happened about year ago here. New
            Jersey is what is called a “Point of Contact” state, where our NICS has
            to go through our state police versus the FBI NICS system. The were
            having massive problems with their system, and delays at one point had
            gone as long as 28 days. There was not one FFL that I know of, who was
            willing to make a transfer without the official NICS response.

(but to hell with getting jobs back) and my view is fire all of the higher ranking ones first, as an example, who turned their backs. let me say this; a spouse cannot, unless they waive their rights, to testify against their counterparts. parents have no rights, to not testify against their children regarding a criminal matter. its your duty to assist the govt. by doing the right thing in not covering up for your own flesh and blood child. however, the blue wall, is blue blood, tried and true and you as a fellow officer, will not be frowned upon if you choose NOT to, “squeal” on your blue blood brother/sister, when you see them violate the law you were sworn to upheld. there are no good cops, when “good” cops look away. but, that’s just me.

        I’d suggest the good cops are very clearly identifiable from the picture by the fact that they have their faces turned toward the people’s representative and their boss whilst they are in uniform.

    Their own regulations say they can be terminated for participating in political activities while in uniform. This is clearly a political statement.
