[su_center_ad]A federal judge has temporarily halted President Obama’s immigration executive order while 26 states pursue action to stop in permanently.

[su_right_ad]U.S. District Judge Andrew Hanen’s decision late Monday puts on hold Obama’s orders that could spare from deportation as many as five million people who are in the U.S. illegally.

Hanen wrote in a memorandum accompanying his order that the lawsuit should go forward and that without a preliminary injunction the states would “suffer irreparable harm in this case.”

“The genie would be impossible to put back into the bottle,” he wrote, adding that he agreed that legalizing the presence of millions of people is a “virtually irreversible” action.

          This Judge is not making new law, but is seeing that the one currently in place is adhered to and a new law is not unconstitutionally created by the Executive Branch of the government. This is quite unlike liberal activist judges who constantly seek to legislate from the bench.

            First of all, the ruling does no such thing. The judge made no decision on the legality of the executive order. The judge issued a temporary injunction to allow plaintiffs more time to file their legal challenge.

            Second of all, thanks for the confirmation of the hypocrisy I was referring to in my prior post. Hypocrites always have a perfectly reasonable explanation for their hypocrisy. You did not disappoint.

            Incidentally, if you cannot cite from memory at least one right protected in each amendment of the Bill of Rights, (as I can) you really have no business lecturing people about the Constitution.

    OK, so if like so many are stating, in government and public forums, the people that are being helped by this executive order are already “leeching “off the government receiving welfare, foodstamps, health care, etc… what harm is being done to the states by allowing the order to go forward?
    I know for a fact that Texas’ budget problems are not the results of these people putting a strain on the state, because the state wasn’t keeping up with budgetary issues anyway.

    This is being appealed and will be overturned. President Obama had this looked over by multiple courts, judges, and scholars and will stand. All this is doing is delaying the inevitable, they are hoping something will magically happen that will support their argument.

      It will be interesting to see the reaction. The ruling is a stay order which forbids the program from being implemented.
      From what I have seen the “registration” starts next week.
      Will it be obeyed?

        The appeal is going through now and I seen where someone said a decision of its implementation should be decided soon.

          possibly by the Friday.

          Which appeals court have you heard it being filed in?
          They are under jurisdiction of the 5th circuit court of appeals in New Orleans.

    Regardless of what past Presidents have done, the question is now before the courts. As such, what was done in the past will not be considered as a factor of allowability. Congress may well have to go back and decide whether to honor past executive orders or begin deportation proceedings against previously amnestied people. I’ll be interested to see how this one turns out.
