She calls herself the “ambassador” for plaintiffs “God and his son, Jesus Christ.”

In the suit, entered into the docket as Driskell v. Homosexuals, Sylvia Ann Driskell, 66, of Auburn, Nebraska, asks in a seven-page, neatly handwritten petition (PDF) that U.S. District Judge John M. Gerrard decide once and for all whether homosexuality is or isn’t a sin.

The suit doesn’t cite any case law under which a judge could make such a determination. In fact, it cites no court cases at all, quoting Webster’s Dictionary and numerous Bible verses, instead, to bolster Driskell’s central contention, which is:

“That homosexuality is a sin and that they the homosexuals know it is a sin to live a life of homosexuality. Why else would they have been hiding in the closet.”

Driskell writes, “I’m sixty six years old, an [sic] I never thought that I would see the day in which our Great Nation or Our Great State of Nebraska would become so compliant to the complicity of some peoples [sic] lewd behavior.”

    Why didn’t the judge toss this thing in the trash can, where frivolous suits belong? Why is this idiot woman being given a soapbox? And “…compliant to the complicity of some peoples lewd behavior.”? What the hell does that even mean? How are gay people more lewd than heteros? Since they are a minority of the population, there’s a whole lot more lewd behavior by straight people. And I still don’t see how gay people’s behavior affects this nimrod.

      Because the procedure does not entail judges scrutinizing every pleading before it is filed. Were that the case, the justice system would be even slower. Furthermore, as a matter of due process, dismissal can only be on notice to the plaintiff, with an opportunity to submit a brief. This is especially true in cases involving pro se plaintiffs. As crazy as it sounds in this case, a procedural rule allowing the court to toss a case without a formal hearing would be very, very unconstitutional.

      As a practical matter, anyone can FILE anything they want. Eventually, the case gets scheduled for a conference, at which time the court may make its own motion to dismiss. Plaintiff will be given an opportunity to submit a brief and later there will be a written decision of dismissal.

        That’s true, you can file any kind of lawsuit you want, but judges have tossed obviously frivolous suits as being a waste of everyone’s time.

    And one more thing. It’s not the courts’ business to decide what is a “sin.” Or even whether “sin” exists. Their business is to deal with crimes. What one person decides is a sin (lying, for example) may not be a crime. If you believe in the concept of “sin,” you have to deal with it on a personal level.

    Uhhn sweetheart? Case dismissed because:

    1. US Courts have no subject matter jurisdiction over matters of religion. Where is the superior knowledge of the Constitution fundies supposedly have?

    2. The District if Nebraska has no personal jurisdiction over people located outside of its territory.

    3. Good luck serving process on every gay in the world, moran.

    4. Thanks for the filing fee and the lulz, the summer clerks need a distraction from the doom and gloom of the law job market and their astronomical student loans.
